SCOPE:<\/strong><\/p>\n

These general terms and conditions of sale apply to all sales made via the website maredsous.sfdbeta.be. They can be printed (print version) or downloaded (download version) by the customer.<\/p>\n

They apply to customers and deliveries in Benelux, Germany and France. For other countries, please send us an e-mail to adrien@maredsous-gin.com<\/a>, with the details required for the order (customer details, items and place of delivery), and we will inform you of the exact price (possibly excluding tax, and always excluding customs duties, which may be payable by the customer) and shipping\/transport costs. If we agree, we will arrange a payment method. It is the buyer’s responsibility to check with the local authorities in the country of residence for any import restrictions.<\/p>\n

The fact that the customer places an order on maredsous.sfdbeta.be implies unconditional acceptance of these general terms and conditions of sale, to the exclusion of all other general terms and conditions.<\/p>\n

The seller reserves the right to modify its general terms and conditions at any time. The conditions applicable to the order are those shown on the website at the time the order is placed by the customer.

ORDER:<\/strong><\/p>\n

There is no minimum order value.
\nThe order is placed by filling in the mandatory fields on the online order form clearly, completely and accurately, following the steps described. The contract concluded is archived by the seller.
\nc. Maredsous SRL<\/span> undertakes to honour orders received on the website only while stocks last.<\/p>\n

In the event of temporary or permanent unavailability of the product, Maredsous SRL<\/span> undertakes to inform the customer within 72 hours and to offer either a new delivery date or an equivalent item, or to cancel the order and reimburse the sums already paid.<\/p>\n

PRICE:<\/strong><\/p>\n

The prices of the items offered on the site are given in Euros. They are deemed to include all taxes, but exclude shipping and handling. The seller reserves the right to change its prices at any time, but undertakes to apply the current price list sent to the customer at the time the order was placed.<\/p>\n

DELIVERY:<\/strong><\/p>\n

Unless otherwise agreed, delivery will be made to the address indicated when the order was placed. Delivery is made by BPost.<\/p>\n

Customers can also collect their parcel from the shop (Ferme de Maharenne – Rue des Abbayes, 39A, 5537, Maredsous-Den\u00e9e – BELGIUM) during working hours. For information purposes only, shipping times are 3 working days. Unless otherwise stated at the time of ordering, the maximum delivery time is 30 days from the date of receipt of payment (for example when the product is no longer in stock).<\/p>\n

Delivery charges are payable by the customer. These costs are listed and detailed when the order is placed. In the case of one-off promotional transactions or deliveries outside Belgium, transport costs are calculated on a case-by-case basis.<\/p>\n

The risks are transferred to the customer as soon as the goods are shipped. If the goods arrive damaged, the customer has the option of refusing them or expressing reservations, confirmed by letter (preferably registered) within 48 hours to the carrier.<\/p>\n

PAYMENT:<\/strong><\/p>\n

The price is payable immediately on the date of the order (activation of the “order with payment obligation” button). Goods will only be shipped or delivered once the price has been received. We accept payment by the following methods:<\/p>\n

By international credit card (Visa, Mastercard, American Express, Bancontact). Secure online payment by credit card is totally safe: it uses the SSL (Secure Socket Layer) protocol. If you are reluctant to provide your personal details online, you can also send them to us by email.<\/p>\n

RETENTION OF OWNERSHIP<\/strong><\/p>\n

The transfer of ownership of the products to the buyer will only take place after full payment of the price by the latter, regardless of the date of delivery of the products.<\/p>\n

PRODUCT, TECHNICAL DESCRIPTION AND PHOTOS<\/strong><\/p>\n

The technical descriptions and photographs of the products on offer have been drawn up with the greatest care by specialists and checked by our staff. However, they are not part of the contract. Therefore, Maredsous SRL<\/span> cannot be held liable for any errors that may have occurred. However, if the customer wishes to return the product following an error in the description, the return will be made at the expense of Maredsous SRL<\/span>, in accordance with the terms and conditions set out in the following paragraph.<\/p>\n

The products offered comply with the laws (directives) of the European Union and Belgium in force. We decline all liability in the event that the product delivered does not comply with the laws of the country of delivery outside the EU. We request our customers to read the information attached to the product or on its packaging (instructions for use, conditions of use, storage, etc.).<\/p>\n

RIGHT OF RETURN AND WITHDRAWAL<\/strong>
\nBe satisfied or get your money back: the customer, as a private consumer, has the right to return a product for any reason whatsoever. They thus have the right to notify the seller, whose details are given in point I, that they withdraw the purchase, without penalty and without giving any reason, within 14 calendar days of the day following the delivery of the goods.<\/p>\n

In this case, the goods must be returned to us within the same period.<\/p>\n

For goods that can be returned by post, the postmark will be taken as proof. For larger parcels, the date of your return request is taken as proof. Please contact our customer service department on 087\/69.28.40, who will tell you how to arrange for the delivery.<\/p>\n

This right assumes that the item is returned to us in perfect condition, in its original packaging. Goods which are not returned to us in this condition, which are incomplete, damaged or which have been unpacked, will not be reimbursed and will remain at the disposal of the buyer, who will be responsible for collecting them from our registered office.<\/p>\n

The costs will be shared as follows:
\nDelivery error, refusal on delivery, description error, damaged parcel on receipt: Maredsous SRL<\/span> will refund the price of the product, any shipping costs invoiced and will bear the return shipping costs.<\/p>\n

Exercising the right of return and withdrawal: Maredsous SRL<\/span> will refund the price of the product (excluding any shipping costs charged). The cost of returning the goods is borne by the customer.<\/p>\n

Exception: in accordance with Article VI.53 of the Code of Economic Law, the right of withdrawal cannot be exercised for:<\/p>\n

the supply of goods that are likely to deteriorate or expire rapidly; the supply of sealed goods that cannot be returned for reasons of health protection or hygiene and that have been unsealed by the customer after delivery.<\/p>\n

Refund will be paid within a maximum of 14 days of receipt of the return, at the discretion of Maredsous SRL<\/span> either by transfer to a bank account or by credit to the bank account of the card used.<\/p>\n

GUARANTEES & AFTER-SALES SERVICE<\/strong><\/p>\n

We guarantee that our products comply with the various European regulations on safety, health, traceability, compliance, etc.<\/p>\n

The guarantee does not cover cases where our suppliers have made mistakes in drawing up the compulsory information for product labelling.<\/p>\n

It is the customer’s responsibility to observe the warnings and special precautions for use of the products.<\/p>\n

In the event of a defect or non-compliance, the buyer may, at the seller’s discretion, obtain free repair or replacement or even reimbursement of the products in the event that replacement or repair are disproportionate or impossible, to the exclusion of any compensation.<\/p>\n

The consumer cannot invoke the legal guarantee for changes in delivery times or place, or for defects of which they were aware at the time of sale.<\/p>\n

The products benefit from:
\nthe legal guarantee of compliance,
\nthe legal warranty against hidden defects resulting from a material, design or manufacturing defect affecting the products delivered and rendering them unfit for use.<\/p>\n

The legal guarantee applies if the non-compliance is noted within 2 years of delivery of the goods.<\/p>\n

DATA PROTECTION<\/strong>
\nAll personal data collected as part of the services covered by these general terms and conditions is processed in accordance with the law of 30 JULY 2018 on the protection of individuals with regard to the processing of personal data, European laws and in particular the General Data Protection Regulation (Regulation 2016\/679, the “GDPR”).<\/p>\n

The purpose of data processing is the execution of the agreement concluded with the customer, customer administration, the promotion of products and services, the establishment of personalised information and direct marketing campaigns, including via e-mail, by Maredsous SRL<\/span> and the companies involved in the execution of the sales contract.<\/p>\n

Customers have the right to access and rectify data concerning them and may at any time, on request and free of charge, object to the processing of personal data concerning them or demand the erasure of personal data transmitted. INTELLECTUAL PROPERTY<\/strong>
\nThe entire website maredsous.sfdbeta.be is protected by Belgian and international laws on copyright and intellectual property. All reproduction rights are reserved, including for downloadable documents and iconographic and photographic representations. Any partial or complete use of the website or its content requires the express written permission of Distillerie de Maredsous SRL.<\/p>\n

DISPUTES, APPLICABLE LAW AND JURISDICTION<\/strong><\/p>\n

We undertake to respond to all complaints by name within a maximum of 10 days from the date of receipt and to seek amicable solutions.<\/p>\n

All our online sales and our relations with customers are governed exclusively by Belgian law, which is therefore the only law applicable to any question relating to the validity, interpretation and performance of these general terms and conditions.<\/p>\n

Any dispute is subject to the exclusive jurisdiction of the courts of the judicial district of Li\u00e8ge, Verviers section (Belgium) unless the customer is acting for non-professional purposes, in which case the dispute is subject, at the choice of the plaintiff, to the jurisdiction of the courts designated by Article 624, 1 \u0364, 2nd or 4 \u0364 of the Judicial Code.<\/p>\n
